On 2 Apr 13 Deputy Sheriff McConnell and the Wesley Fire Department responded to a structure fire on the property of Lemuel Mayle, age 52, at 644 Southland Cemetery Road, Cutler. Mr. Mayle was burning trash in a barrel near his storage building when the wind blew flames against the building. The building and an inoperable Chevy van parked nearby were a total loss.

On 2 Apr 13 Deputy Sheriff Bobo charged Washington County Jail inmate Ryan M. Miller, age 26, 30425 Lovett Road, Portland, OH, with assault. Without provocation, Mr. Miller punched inmate James Gardner, age 41, 36225 Wells Road, Middleport, OH, in the back of the head multiple times while the two were being escorted inside the jail. Mr. Gardner was not seriously injured.


Two suspects, one being a substitute teacher, were arrested yesterday on charges related to sexual conduct involving teenage girls. Investigations by the Major Crimes Task Force revealed Devin Binegar, age 24, 49 Waugh Street, Newport, and Shane Dye, age 24, 70 Wilson Street, Newport, committed their crimes around July 2011.

A substitute teacher at Frontier High School, Binegar met a fifteen year old female at a party and subsequently engaged in sex with the teenager at a residence in Washington County. The two engaged in sex a second time following another party the same month.

In an unrelated incident, Dye also engaged in sex with a fifteen year old female he met at a party in Newport. After consuming moonshine the victim reportedly blacked out and was transported by friends to a home in Marietta along with Mr. Dye. At the home, the victim fell asleep on a couch and awoke to find she was no longer wearing her pants. When she asked why her pants were off Mr. Dye stated they were off because they had sex. The teenager informed Task Force Agents that she never consented to having sex and commented that she had no relationship with Dye prior to the incident. The teenager later gave birth to a child. DNA test results indicate there is near 100% probability that Dye is the father.

As a result of the investigations, Binegar was arrested on a fourth degree felony charge of unlawful sexual conduct with a minor. He is currently free after posting $15,000 bond. Dye was arrested on a first degree felony charge of rape and remains incarcerated in the Washington County Jail in lieu of $250,000 bond.

It is believed that Binegar and Dye frequent parties in the area where teenage females are present and may have engaged in sexual activities with other underage females. Detective Hornbeck requests anyone with information on these possible activities to contact him at 740-376-7070.

Seth E. Harris, age 21, 3000 Barnett Ridge Road, Fleming, for domestic violence committed on 7 Mar 13.

Justin E. Wolfe, age 19, 138 Harmar Street, Marietta, for failing to appear for pretrial on 25 Mar 13.

Nathan A. Bunner, age 29, 21446 Broadwell Street, Stewart, OH, for driving under a suspended license, for operating a vehicle with fictitious plates and for not wearing a seat belt on 21 Mar 13.

Michael Zapolski, 15728 Waterford Road, Waterford, for issuing a bad check for $100 to Sponey’s IGA on 12 Nov 12.

The following individuals were processed into the Washington County Jail:

Wayne Anthony Rhodes, age 24, 6944 Circle 33 Road, Nelsonville, for failure to appear and for two counts of theft, all felonies. Rhodes was picked up at the Athens County line by Lt. Rhodes of the Washington County Sheriff’s Office and processed into the Washington County Jail on 2 Apr 13 at 1:53 am.

Merle Dean Hughes, age 58, 1225 Plum Run Road, Waterford, for failure to appear, a misdemeanor. Hughes was arrested in Marietta Municipal Court by Deputy Sheriff O’Brien and processed into the Washington County Jail on 2 Apr 13 at 12:19 pm.

Dustin Tyler Marcum, age 20, 282 Ridgewood Drive Apt. E, Marietta, for violating the terms of his probation, a misdemeanor. Marcum was arrested at the office of Probation Officer P. Brockmeier and processed into the Washington County Jail on 2 Apr 13 at 1:35 pm.

Mary Ellen Desjardins, age 26, 6419 E. Valley Road, Mount Pleasant, MI, for failure to appear, a misdemeanor. Desjardins was arrested near milepost seventeen on Interstate 77 by the Ohio State Highway Patrol and processed into the Washington County Jail on 2 Apr 13 at 4:54 pm.

Ira David Blair Jr., age 28, 139 Groves Avenue, Marietta, for burglary, a felony. Blair was arrested in Marietta by Patrolman Linscott of the Marietta City Police Department and processed into the Washington County Jail on 2 Apr 13 at 8:55 pm.
