On 3 Sep 11 Lt. Stackpole and Deputy Sheriff McLeish responded to reports of an intoxicated driver traveling on State Route 7 in Newport. Located at Byers in Newport, the driver of the vehicle, Benjamin M. Hudson, age 21, 3185 Turkey Fork Road, Sandyville, WV, was uncooperative at cursed at Lt. Stackpole. Mr. Hudson initially provided another individual’s driver’s license but later positively identified. Mr. Hudson grew increasingly aggressive after Lt. Stackpole noticed a collapsible baton and a vial of powder Mr. Hudson attempted to conceal under his leg. When Lt. Stackpole attempted to retrieve the baton, Mr. Hudson exited his vehicle in an aggressive manner, causing Lt. Stackpole to believe he was going to be assaulted. Mr. Hudson was subsequently subdued with Lt. Stackpole’s Taser and taken into custody on charges of assault, carrying a concealed weapon and obstructing official business. The passenger in the vehicle, Jason Staats, age 19, 64 Midway Acres, Ripley, WV, cooperated with Deputy Sheriff McLeish and admitted the can of beer found in the vehicle belonged to him and that he drank it as they traveled. Arrested for underage consumption of alcohol, Mr. Staats was transported to the Washington County Jail along with Mr. Hudson. Inside Mr. Hudson’s vehicle, the Deputies discovered a large quantity of flavored rolling papers as well as items believed to be synthetic marijuana and bath salts.
