On 15 May 08 Lt. Schuck requested a summons for Mark J. Tilton, age 39, 12622 State Route 60, Lowell, for first degree misdemeanor charges of assault and aggravated menacing. Stemming from an incident that transpired on 21 Mar 08, Lt. Schuck’s affidavit alleges that the victim in the case, Andrew Mahoney, age 39, 508 Bear Creek Road, Lowell, believed Tilton would cause him serious physical harm. Witnesses confirm that at the time of the incident Tilton was seriously enraged at improprieties he perceived Mahoney committed and in his state of mind could have killed Mahoney. On several occasions Tilton made comments threatening to rip out Mahoney’s throat, causing Mahoney such distress that he armed himself with a handgun in case Tilton would return.

Prior to Tilton’s departure from the scene of the incident, Mahoney said he entered his own vehicle to leave when he heard someone speaking. Thinking they were speaking to him, Mahoney rolled down his window, at which time Tilton punched him in the face. Witnesses present confirmed seeing Tilton punch Mahoney through the open window.
