Rutheford was observed that afternoon selling ¼ pound of marijuana to an individual at a residence in Lawrence Township, for which $620 was paid. Immediately after the transaction Detectives arrested Rutheford in the driveway of this residence and located the money used to purchase the marijuana in his front left pants pocket. A further search of the defendant’s vehicle by officers revealed four blue oval pills, believed to be Xanax, located in cellophane between the console and the driver’s seat. After being read his Miranda rights, Pethel admitted that he had observed officers arrive, recognized their unmarked cars and flushed an unknown amount of marijuana down the toilet to avoid detection.
