At 11:20 am on 16 Feb 07 a pharmacist at K-Mart reported to
Detective Mark Warden that a customer at the pharmacy was trying
to pass a prescription for 120 Lortab 10/500 tablets and he
believed the script was not valid. At the pharmacy, the pharmacist
informed Detectives that Eric Gurganus, age 28, 300 17th Street
Parkersburg, came to the Pharmacy and tried to pass two prescriptions
for Hydrocodone. The pharmacist believed that a prescription
for 60 Lortab 5/325 was a valid prescription from a local doctor
and filled the script. Confirming with the doctor that he wrote
one script, the Detectives awaited the return of Mr. Gurganus.

the allegedly forged script, at which time he admitted taking
a blank prescription when he received his prescription from
the nurse’s counter at his doctor’s office. At
that time Mr. Gurganus was arrested for using deception to
obtain a dangerous drug and was transported to the Washington
